今天收信時，發現有一陣子沒見面的高職同學，轉寄了幾封信給我。

舉凡比較嚴重的罪好像都是屬刑事，如性侵、殺人…，所以如果以刑事提起公訴的話，以效率來說，是比民事訴訟好很多。
不過，侵佔算是刑法公訴罪，但追討欠款反而是民法，其實都是想要把欠款拿回來，可是就是不一樣。這算是法律認定「金錢」的「所有權人」不同吧！？
如果是寫借據或本票，該筆「金額」的「所有權人」是對方，而自己是對方的「債權人」，對方叫「債務人」。
債務人有義務償還積欠債權人的款項，債權人有權利向債務人摧討款項。（很像繞口令）
不過一切權利義務都不是很強硬…，自然整個訴訟時程就拉長了～，不一定拿不到錢，只是會在上訴、再上訴當中花掉不少時間。
不過時間就是金錢～…
但如果是寫保管條的話，該筆「金額」的「所有權人」仍然是自己，只是暫時寄放他人，當然時效到了對方不還，就算是侵佔罪了。
而證人、證物當然是越多越好，最好還能錄影或錄音存證。
不過，台灣司法中的法官不是百分之百都是公正無私的，雖然我相信大部分是，但運氣不好的話還是會遇到那「鍋中的老鼠屎」。
這又會讓訴訟結果增添些無法控制的變數…
所以還是少借別人錢為妙，不然就是借出去就當作百分之百回不來了。
與其花那些時間在追那些「已經出自己口袋，但以為它們還會回來」的錢，倒不如去用那些相同的時間賺更多的錢或充實自己。
